This law would encourage deforestation, violate the governance of indigenous populations and generate impunity in judicial proceedings.<\/p>\n\n\n\n<p>Through a resolution signed by the 7 magistrates of the Constitutional Court, the entity transfers the lawsuit to the Congress of the Republic, which is given a term of 30 business days to appear in the process and answer the lawsuit.<\/p>\n\n\n\n<p>The courts admitted the lawsuit after confirming that it complies with the admissibility and procedural criteria established in the Constitution, the New Constitutional Procedural Code and in the jurisprudential doctrine of the Constitutional Court, thus initiating the process to declare the unconstitutionality of the so-called &#8220;Antiforestry Law&#8221;.<\/p>\n\n\n\n<p>The lawsuit filed by the Regional Government of San Martin claims that the approval of Law No. 31973 does not comply with constitutional provisions and international treaties that have constitutional rank. It also argues that prior consultation with the indigenous peoples was not carried out for the approval of said law; it also states that it violates the principles related to the forestry regime and the duty to preserve a balanced environment established in articles 67, 68 and 69 of the Constitution.<\/p>\n\n\n\n<p>Finally, it argues that the law threatens the property rights of native communities and would give impunity in criminal matters to people who have deforested the forests and who are currently being prosecuted.<\/p>\n\n\n\n<p><br\/>It should be noted that the National Assembly of Regional Governments, the Regional Government of Amazonas, the Regional Government of Hu\u00e1nuco and various organizations specialized in environmental matters (including the Foundation for Conservation and Sustainable Development <br\/>) issued statements to demand the repeal of this law, which was approved at the insistence of the Congress of the Republic.<\/p>\n\n\n\n<div data-wp-interactive=\"core\/file\" class=\"wp-block-file\"><object data-wp-bind--hidden=\"!state.hasPdfPreview\" hidden class=\"wp-block-file__embed\" data=\"https:\/\/fcds.org.pe\/wp-content\/uploads\/2024\/08\/Auto-Tribunal-Constitucional.pdf\" type=\"application\/pdf\" style=\"width:100%;height:600px\" aria-label=\"Embed of Auto Tribunal Constitucional.\"><\/object><a id=\"wp-block-file--media-4640ceaf-c75d-47d0-ada0-ff4fe739a0c4\" href=\"https:\/\/fcds.org.pe\/wp-content\/uploads\/2024\/08\/Auto-Tribunal-Constitucional.pdf\">Constitutional Court Order<\/a><a href=\"https:\/\/fcds.org.pe\/wp-content\/uploads\/2024\/08\/Auto-Tribunal-Constitucional.pdf\" class=\"wp-block-file__button wp-element-button\" download=\"\" aria-describedby=\"wp-block-file--media-4640ceaf-c75d-47d0-ada0-ff4fe739a0c4\">Download<\/a><\/div>\n<\/div><\/div>\n","protected":false},"excerpt":{"rendered":"<p>Lima, April 9th, 2024.
