Now, how am I going to charge a person who is dedicated to logging or deforestation? If with the new law they are already indicating that if he has cut down trees for agriculture then I am going to condone it (…) I will no longer be able to investigate him because it was for agriculture and, practically, they are rewarding the person who is going to do the logging”, the provincial prosecutor pointed out.
These statements were made during a discussion organized by the Foundation for Conservation and Sustainable Development (FCDS Peru), Environmental Law and Natural Resources (DAR) in the framework of POLLEN 24 held at the Pontificia Universidad Católica del Perú (PUCP), an event that brings together various specialists in environmental and social issues.

Increased risks

In this discussion, the vice-president of the Regional Organization of Aidesep in Ucayali (ORAU), Herlin Odicio, regretted that this amendment has not been consulted with the indigenous peoples, as he pointed out that it will increase the invasion of their ancestral territories, putting the lives of the native populations at risk.

“When they heard about the modification of the Forestry Law, they have pushed the invasion with full force (for example, around the Nueva Italia-Breu highway). The coca growers are recruiting young indigenous people in Tahuanía to be backpackers, they are recruiting girls and prostituting them. Who controls this? (…) We are not against development, but we want them to respect our territory and our rights”, emphasized the indigenous leader.

Williams Arellano, Serfor’s Director of Sustainable Management of Forest Heritage, reported that 40% progress has been made in the restoration of degraded areas of a first target of 330,000 hectares, which in turn are part of a total of 2 million hectares prioritized. He also reported on the multiple challenges in terms of institutional capacities, financial resources and technical knowledge to promote restoration projects.

Meanwhile, according to the data analyzed, the technical specialist of the United for Forests initiative of the FCDS Peru, Fernando Regal, warned that three Amazon regions (Ucayali, Loreto and San Marti n) have already exceeded half a million hectares of deforested forest, so it is urgent to take coordinated measures to prevent further loss of forest cover.

“The challenges we face in addressing deforestation are many. The reality is complex, both socially, economically and legally. It is necessary to advance an articulation between all levels of government and organizations, both at the public, private and civil society levels in order to combat the causes of deforestation,” he said.

Conserving forests

The president of the National Forestry Ca mara, Ignacio Lombardi, informed that since 2001 to date there has been a 43% reduction in permanent production forests in Peru, with the regions of Pasco, Junín, San Martín, Loreto and Puno registering the greatest loss. On the other hand, he expressed the need to contribute to the regulation process of the modification of the Forestry Law.

Likewise, the executive director of DAR, Hugo Che Piu, considered that this amendment will increase the levels of deforestation in Peru, in addition to putting indigenous environmental defenders at risk, but also stressed that the Peruvian State is not complying with international treaties, particularly those related to the fight against climate change and deforestation.

Finally, the specialist of the Peruvian Society of Environmental Law, Flor Cabanillas, commented that the impact of the European regulation on deforestation must be taken into account, given that the implementation of the land classification regulation and other norms have not proven to be effective.

Lima, June 13, 2024.
